From plumber to gastro and helicopter event organizer

When we received a B2018B debt collection case for several thousand francs from one of our largest customers in the beverage production and distribution sector in January 2, our clerks initially thought that the case would be irrecoverable at short notice, as the debtor, let's call him * Franco Möller, according to the debt collection information with half a million CHF in the chalk. * (Name changed)

The case was therefore handed over to our debt collection specialists for a more detailed case analysis. They not only found out that Franco Möller is no ordinary pub, but also offers helicopter sightseeing flights and exclusive flights to company and gourmet events on some alp with all the trimmings.

Exceptional wedding and romantic excursions with photo shoots are just as much a part of the offer as domestic and international taxi flights for the VIP jet set and those who would like to be.

But does the debtor actually have his own fleet of helicopters and a flourishing transport company, as his two websites with the company logo on the helicopters and exclusive company domicile right at the airport suggest?

Unfortunately no, all just deceptively real photo montages and brazen misinformation. Möller does not own any helicopters. These are only chartered by him. This is also confirmed by the long list of debt enforcement and loss certificates, which are teeming with domestic and foreign helicopter companies, which are sometimes also waiting for Franco Möller to settle outstanding claims.

But we're also working on it ... Most of these companies have since handed over their collection mandate to us when they found out that we were successful in the supposedly hopeless case of "Franco Möller".

How could we persuade the heavily indebted and therefore officially destitute debtor to settle our debt collection case?

During our amicable collection phase, Mr. Möller came to us with the request for payment in installments, which we would have gladly complied with (in view of the circumstances) if he had signed the payment agreement and adhered to the agreed installment payments. But unfortunately these were once again just empty promises and an attempt to buy time and let the matter peter out.

While many debt collection companies give up at this point at the latest and do not invest any further resources in the case, our experts became even more active and researched further. These clarifications ultimately resulted in the following: The debtor had a pending registration for a trademark right at the Institute for Intellectual Property, which allowed us to draw conclusions about his gastronomic activities in connection with helicopter tours. Furthermore, we were able to document extensive event and rental material that can be booked or rented from Mr. Möller. Our specialists were even able to find out a bank account to which customers have to make the necessary payments after booking their flight events.

On the basis of this research, despite the debtor's total bankruptcy, we immediately initiated proceedings. As expected, the debtor acknowledged the claim, which is why we were able to immediately demand the continuation of the pursuit of seizure, explicitly by means of seizing the detailed documented event and rental material and in particular the bank account mentioned.

Just 10 days later Möller contacted us and wanted to settle his debt subito, but he had only one small problem: his bank account had been blocked by the responsible debt enforcement office on our instructions, so he could not pay everything at once and would like to make a larger partial payment immediately. We received it by return of post. However, we held on to the seizure in order to maintain the pressure to pay on the debtor. Therefore, we enabled the debtor to pay the rest in two more installments.

In July of the same year, the debtor paid the last tranche (including all collection costs) directly to the debt enforcement office, so that we and the case to our delight to the great satisfaction of our long-term customer, as another exemplary “success story”.

Such success stories are one of the reasons why many SMEs, very large and renowned Swiss companies, as well as international corporations, have placed their trust in us for over 50 years.
