At the end of 2019 we received an unpaid invoice for CHF 270.00 from one of our customers. Various maintenance work was carried out on a vehicle and then correctly charged. The debtor did not respond to any amicable effort on the part of the customer.
Our request for payment was ruthlessly ignored by the debtor. Our offer that a solution could be found with an installment agreement was also not accepted. Because of the rather small amount due, we then contacted our customer. Our customer felt he was being betrayed because his correctly performed services and the resulting expenses were not paid. For this reason, the customer decided to pursue the case as a “principle case”. Our specialists then initiated the debt collection procedure. As expected, the claim was then contested by means of a legal proposal. Our in-house lawyers then carefully checked the facts again. The excuses used by the debtor were by no means well founded. The debtor announced that he did not agree with the invoice because he could get these spare parts cheaper on the Internet. Furthermore, he had obtained an advance payment before placing the order, but this was never the case. We therefore initiated the justice of the peace suit at the competent office.
The debtor was present at the hearing on September 09.09.2020th, 16.09.2020 and was already noticed before the start of his behavior. The debtor made fun of our lawyer, the client and the entire court assembly. The interests of our customer were confirmed by RA lic. Iur. Bojan Petkovic represented. Since it was not possible to find a satisfactory solution at this oral hearing, the mediator issued the authorization to take legal action and added that the proceedings will be further negotiated before the district court in the decision procedure. The mediator hoped that the defendant would have less stage in the written procedure for his stubborn arguments. Even before this case could be negotiated, we suddenly received full payment from the debtor on September XNUMX, XNUMX without comment. The entire claim as well as the resulting legal costs were paid. Through the pressure exerted specifically on the debtor, we managed to get him finally to give in.
